!o <br /> MEMORANDUM <br /> Memo To :Mayor and Council Members <br /> From :Ric Minetor, Acting Clerk-Administrator <br /> Date :November 29, 1990 <br /> le41‘444:424:- <br /> Subject :Non-Intoxicating Liquor License Location Concerns <br /> I have discussed the issue of ineligible locations for non- <br /> intoxicating liquor licenses with the City Attorney, Mark Karney. <br /> Our concern is that the wording of the ordinance is somewhat <br /> vague; the ordinance requires that any place within 500 feet of a <br /> church or school not be given an off-sale non-intoxicating liquor <br /> license . The question is whether this distance is between <br /> property lines of the school or church and the place requesting <br /> the license or is the distance to be measured from building to <br /> building. For intoxicating liquor licenses the code clearly <br /> states the 500 feet is from property line. <br /> Mark and I feel that the Council needs to determine the intent of <br /> the ordinance: Mark feels either interpretation is defensible. He <br /> does request that if the Council determines that the distance is <br /> to be measured between property lines, then the ordinance should <br /> be revised to clearly state this interpretation. <br /> Staff is requesting Council direction on this matter. <br />
