'n-c- <br /> MEMORANDUM <br /> Memo To :Mayor and Council Members <br /> From :Ric Minetor, Acting Clerk-Administrator <br /> Date :November 14, 1990 /%, � <br /> Subject :Hazardous Material Response - Designation of <br /> Spring Lake Park, Blaine, Mounds View Fire Department <br /> as City's Agent for First Response <br /> I have met with the Fire Chief , Ron Fagerstrom, regarding <br /> hazardous material spills and the liability of clean-up. The fire <br /> department is the first responder and their efforts are limited <br /> to the initial control of the spill. Clean-up and disposal is <br /> nearly always provided by an independent contractor. To date, <br /> this has not been a problem as the fire department has known the <br /> who the responsible party was and secured permission to proceed. <br /> The independent contractors require guarantees of payment and <br /> this has been authorized by the responsible party. <br /> 411 The fire department's concern is the possibility of not knowing <br /> or not being able to contact the responsible party. Their concern <br /> is that in such a case the clean-up contractor will not respond <br /> with out a guarantee of payment. The fire department is <br /> uncomfortable with guaranteeing payment and has requested that <br /> they be designated as the City's agent for these situations. The <br /> City has the ability to assess costs to a property or obtain <br /> reimbursement from State and/or Federal agencies . The fire <br /> department would be the City's agent in these cases, ordering the <br /> clean-up and dealing with the appropriate agencies. <br /> I have discussed this with the City Attorney, Mark Karney, and we <br /> aarPAd to - - - - • of . - - . .n-tin' the Fire De.artment <br /> as the City's agent is all that would be necessary.
