Mounds View City Council October 22, 1990 <br /> Regular Meeting Page Three <br /> Vicky Crowe, 8145 Long Lake Road, the applicant, <br /> stated she had had a list signed by her surrounding <br /> neighbors, stating they had nothing against this <br /> proposal . <br /> Acting Clerk/Administrator Minetor explained the <br /> Council has the right to waive a public hearing, <br /> but cautioned they have never done so before. <br /> Mayor Hankner stated she was concerned with being as <br /> strict as possible to make sure there was a true <br /> public review and opportunity for input . <br /> Attorney Karney advised an agreement could be drawn <br /> up approving the placement of the footings at this <br /> time, with the stipulation they be removed if the <br /> permit is not granted. However, there could be <br /> problems in trying to enforce that later on, if the <br /> permit isn ' t granted, and it could be very expensive <br /> for the City to have to take civil action. <br /> Ms. Crowe stated she has lived there 17 years and <br /> enjoys the wetland, and the addition they are planning <br /> is to put up a screened porch to further enjoy the <br /> . wetlands . <br /> Councilmember Blanchard stated she was concerned as <br /> many people have said the city is weakening the <br /> ordinance by giving so many permits. She stated she <br /> agrees this is a legitimate problem, but the Council <br /> must uphold the ordinance, which calls for a hearing . <br /> Councilmember Quick stated there were two options <br /> available, to enter into an agreement or waive the <br /> public hearing. <br /> Mr. Minetor noted that if they allow construction <br /> to begin and then deny it during the public hearing <br /> process, they would still have to go through another <br /> public hearing to have it taken out. <br /> Councilmember Wuori ` noted in planning issues, cost <br /> factors are not an acceptable hardship and cannot be <br /> considered. <br /> Motion: Quick to waive the permit requirements and <br /> issue a building permit . <br /> The motion failed for lack of a second.
