As we have <br /> discussed previously, the City can only enforce those items <br /> specifically addressed in the municipal code . Permits for <br /> 0 filling, excavation, or similar activities are only required when <br /> the value of the work exceeds $350. We- have liberally interpreted <br /> this to mean the aggregate value of phased work, rather than the <br /> value of each phase. Because of this interpretation we required <br /> you to obtain a permit for the recent fill you placed on your <br /> lot. We also requested a grading plan for this fill. <br /> I am aware of your neighbor's concerns with drainage from his <br /> rear yard. However, we can only review the grading plan in <br /> reference to the conditions at the time the plan is required. The <br /> information I have received to date does not indicate that the <br /> fill and grading you have done under the permit has created any <br /> new or compounded any existing drainage problem. Your neighbor <br /> contends that the original work, which did not require a permit, <br /> caused drainage problems: However, this is not an issue that we <br /> can address . This is because the problem was created or <br /> compounded at a time when we did not have authority over the <br /> activity in question. <br /> I have spoken with Mr. Hyser and he has indicated same <br /> willingness to work with you to resolve the situation.
