August 3 , 1990 <br /> Scott Hyser <br /> 7340 Spring Lake Road <br /> Mounds View, Mn. 55112 <br /> RE: Grading Activities on Property at 3001 County Road H-2 <br /> Dear Mr. Hyser: <br /> This letter is to document the City's position regarding your <br /> concerns with the fill and grading taking place on your <br /> neighbor's property. As we have discussed previously, the City <br /> can only enforce those items specifically addressed in the <br /> municipal code. Permits for filling, excavation, or similar <br /> activities are only required when the value of the work exceeds <br /> $350. We have liberally interpreted this to mean the aggregate <br /> value of phased work, rather than the value of each phase. <br /> Because of this interpretation we required Mr. Glomski to obtain <br /> a permit for the recent fill he placed on his lot. We also <br /> requested a grading plan for this fill. <br /> I am aware of your concerns with drainage from your rear yard. <br /> However, we can only review the grading plan in reference to the <br /> conditions at the time the plan is required. The information I <br /> have received to date does not indicate that the fill and grading <br /> Mr. Glomski has done under the permit has created any new or <br /> compounded any existing drainage problem. Your comments that the <br /> original work, which did not require a permit, caused drainage <br /> problems are, unfortunately, not an issue that we can address. <br /> This is because the problem was created or compounded at a time <br /> when we did not have authority over the activity in question. <br /> I have also spoken with Mr. Glomski and he has indicated that it <br /> is not his intent to create a problem for you nor compound any <br /> existing problem. He feels your problem has existed for some time <br /> and does not feel that he should be solely responsible for <br /> remedying a previously existing problem. I realize that this is <br /> not the way you see the situation. Mr. Glomski has indicated a <br /> willingness to work with you to resolve the situation. To that <br /> end I am enclosing a reference for a mediation service, if you <br /> and Mr. Glomski feel that this would help. I would hope that you <br />
