� a <br /> kieti)(11L. /4 <br /> MEMORANDUM <br /> 411 <br /> TO: Mayor and City Council <br /> FROM: Clerk-Administrator Pauly `��� <br /> DATE: July 20, 1990 ��� <br /> SUBJECT: REGULATION OF UNDERGROUND TANK TESTING AND SPILL <br /> CLEAN-UP <br /> As a result of recent incidents of leaking underground tanks <br /> in the City of Mounds View at Brooks Superette and the Fina <br /> station on County Road I, Councilmember Wuori inquired as to <br /> the ability of the City to adopt an ordinance which would be <br /> more restrictive than State and Federal regulations on the <br /> testing of underground tanks and clean up of spills. <br /> Attached please find a letter from City Attorney Karney <br /> outlining his opinion as to our authority to regulate these <br /> items in a manner which is more restrictive than the State of <br /> Minnesota or Federal Government. The essence of Attorney <br /> • Karney's opinion is that the City may be more restrictive as <br /> long as our ordinance is not in direct conflict with State or <br /> Federal regulations . As a result of this information, Staff <br /> would request Council direction as to your desire to implement <br /> a more restrictive underground tank testing and spill clean up <br /> ordinance for the City of Mounds View. <br /> DFP/BAB <br /> Attachment <br /> • <br />
