RESOLUTION NO. 3023 <br /> 111 PAGE TWO <br /> 1. The facility must, at all times, be in compliance <br /> with State Laws and Minnesota Pollution Control <br /> Agency Standards for air quality and noise <br /> 2 . The hours of operation shall be 24 hours. After <br /> one year of operation the City shall hold a public <br /> hearing to solicit input on the hours of opera- <br /> tion. If there are any negative comments, the <br /> hours of operation may be reduced. <br /> 3 . Outside loud speakers shall be utilized for <br /> clearing pumps only. <br /> 4. Outside merchandising shall be limited to the <br /> concrete entrance slabs to the building. Outside <br /> merchandise stacking shall not exceed four feet. <br /> 5. The single pedestal sign and all others shall be <br /> located on the site plan. Signage shall be in <br /> conformance with Municipal Sign Code. <br /> 6 . If for any reason the gasoline sales portion of <br /> the business closes for a one year period, the <br /> conditional use permit shall be null and void and <br /> 411 the underground tanks shall be emptied and filled <br /> with sand or removed. <br /> 7 . The car wash facility shall include a blower <br /> system designed to remove as much water as <br /> feasible from the vehicle before it is allowed to <br /> exit the facility. This equipment shall operate <br /> as a customer option from April 16 to October 14 <br /> and as a mandatory service from October 15 through <br /> April 15. <br /> between the City and the Developer. <br /> 9 . That all appropriate permits are obtained <br /> including, but not limited to, MnDot, Rice Creek <br /> Watershed District, Army Corps of Engineering, <br /> Fire Department and Pollution Control Agency. <br />
