h � <br /> MEMORANDUM ITEM: jaL, <br /> 411 <br /> TO: Mayor and City Council <br /> FROM: City Planner, Michelle Hren <br /> DATE: March 28, 1990 <br /> SUBJECT: Phillips 66 Conditional Use Permit <br /> Phillips 66 has applied for Conditional Use Permit's for a motor <br /> fuel station and a car wash at the site of the Long Lake 66 station <br /> on the corner of Highway 10 and Long Lake Road. <br /> Phillips 66 has also applied for a variance from the required 50 <br /> foot driveway setback from the intersection of two streets. The <br /> Planning Commission has denied the variance request for the reasons <br /> stated in Planning Commission Resolution No. 282-90 . Additionally, <br /> City Engineer, Minetor has recommended that access to Long Lake <br /> Road be eliminated and access be gained to the site from only <br /> Bronson Drive and Highway 10. The Planning Commission was in favor <br /> of this recommendation. <br /> The Planning Commission reviewed the Variance proposal and also <br /> • requested comment from the City Attorney regarding the presented <br /> hardship statement and the possibility- of the Long Lake Road access <br /> being grandfathered in. Basically, the Attorney indicated that no <br /> hardship exists and there are no grandfather rights regarding the <br /> existing access into the site. City Attorney, Karney's letter is <br /> attached for your reference. <br /> Phillips 66 is pursuing the Variance request at the City Council <br /> level. The variance request must be addressed prior to the <br /> Conditional Use Permit review particularly due to the access issue. <br /> The Planning Commission is aware that the City Council will review <br /> e p ans • - • • - = _ • : - • <br /> the CUP request. The Planning Commission indicated. that the CUP <br /> would be approved provided all the changes have been made. <br /> Enclosed as part of your packet is the latest site plan submitted <br /> by Phillips 66 which includes the relocated access curb cut on <br /> Bronson Drive as requested. Also attached is a copy of the Planning <br /> Commission resolution addressing the CUP's. <br /> Staff is looking for direction as to the appropriate resolution to <br /> prepare for this request which includes the variance and the <br /> Conditional Use Permit's . <br /> III F:CCMPHILI <br />
