• <br /> MEMO TO: PLANNING COMMISSION • <br /> FROM: CLERK-ADMINISTRATO 4010 <br /> DATE: APRIL 25, 1990 <br /> SUBJECT: REQUEST OF TERRY AND JAY SHERMAN, <br /> 8443 RED OAK DRIVE TO CONSTRUCT SECOND <br /> PRINCIPAL STRUCTURE <br /> Attached please find a letter from Terry Jo and Jay Sherman of <br /> 8443 Red Oak Drive to myself and the City Council requesting <br /> the City Council's approval that they be allowed to build a <br /> new house at their address while residing in the existing <br /> house with an assurance that the existing house would be <br /> removed or destroyed after the new house is completed and <br /> occupied. <br /> Also attached please find a memorandum from City Planner Hren <br /> with attachments outlining the requirements the City has <br /> placed on two previous requests of a similar nature in 1982 <br /> and 1987. I have reviewed with Mr. Sherman these requirements <br /> and he has agreed to enter into a written agreement with the <br /> City which would obligate the construction of the new <br /> residents within a specified period of time, immediate • <br /> occupancy upon issuance of an occupancy certificate and <br /> demolition or removal of the existing structure within a <br /> stated period of time thereafter. Mr. Sherman indicated to me <br /> that he would need to talk to his builder, Daily Construction, <br /> to determine whether or not they would agree to be <br /> contractually obligated to complete the house within a stated <br /> period of time. Mr. Sherman did indicate some concern <br /> regarding the financial obligation of providing a security <br /> equivalent to the cost of demolition and lot restoration as <br /> was required of Ms. Preciado but not required of Mrs. Wille. <br /> Prior to the City Council receiving this request at their <br /> May 7 Agenda Session, I would ask that the Planning Commission <br /> review this material and provide the City Council with your <br /> recommendation for inclusion in the May 7th packet.
