MEMORANDUM <br /> TO: Clerk/ Administrator, Don Pauley <br /> FROM: City Planner, Michelle Hren <br /> DATE: May 2, 1990 <br /> SUBJECT: Planning Commission Meeting , May 2, 1990 <br /> I will be at a conference Thur. and Fri. <br /> The Planning Commission tabled action on the Fina variance request <br /> pending information from Mark Barney. They want this information <br /> by MONDAY NIGHT BECAUSE THEY SET A SPECIAL MEETING WITH THE CITY <br /> COUNCIL ON MAY 7 AT 7:00PM TO DISCUSS THIS ISSUE. They felt that <br /> the City Council may want to have input in this variance request. <br /> I will try to contact Mark during my MnApa Conference to find out <br /> his response to: <br /> 1. Can the City require that the three untouched tanks be replaced. <br /> 2. Whose responsible for the tanks that do not leak at this time, <br /> • but may later. Fina owns the station now, but Coon Oil is the <br /> responsible party now. <br /> 3. Should this be considered as a Conditional Use in addition to <br /> a variance because we may see more of these systems at other <br /> gas station sites. <br /> 4. Can they put a time limit on this variance request. <br /> 5. Can they put $ assurance on the removal of the structure. There <br /> was discussion regarding the permanency of the structure and <br /> the PC was not opposed to having them remain as monitoring <br /> wells once the contamination cleanup was completed. ( 18 months <br /> -2 years) . <br /> If Mark determines that a variance (setback) is all that is <br /> required, the Planning Commission is expecting to discuss this with <br /> the City Council at 7:00 PM and call to order during the City <br /> Council meeting If Mark determines that a <br /> conditional use permit would also needed to address this issue the <br /> PC will not call to order and will wait until their next meeting. <br /> The reason for this rush is because the Mn PCA has determined that <br /> there is danger at the site and are afraid that an explosion may <br /> occur. THis is due to the location of sewer line. The site is being <br /> monitored for fumes from the sewer line. <br /> • <br /> I will fax this to Mark tonight so he hopefully will have a copy <br /> tomorrow, Thursday to discuss this. <br />
