<br /> <br />Ordinance 771 <br />Page 2 <br /> <br /> <br /> <br />SECTION 3. Section 502.11 of the Mounds View Municipal Code pertaining to “Conduct of <br />Business, Conditions of License” is hereby amended with the proposed additions underlined: <br /> <br /> 502.11: CONDUCT OF BUSINESS; CONDITIONS OF LICENSE: <br /> <br /> Subd. 8. Consumption in Parking Lots: No person may loiter or consume or have in <br />their possession any bottle or receptacle containing intoxicating or nonintoxicating <br />liquors on any premises licensed for the on-sale or off-sale of intoxicating liquors while <br />outside of the building or structure located on the licensed premises, including but not <br />limited to parking lots, driveways and landscaped areas, as well as steps, <br />passageways or vestibules located outside of said building or structure, except as <br />provided by Sections 502.03, Subdivision 8 and 503.03, Subdivision 1 (c). Any person <br />in violation of this subdivision shall be guilty of a misdemeanor. <br /> <br /> <br /> <br />SECTION 4. Section 503.03, Subd. 1 of the Mounds View Municipal Code pertaining to <br />“License Classifications” is hereby amended with the proposed additions underlined: <br /> <br /> 503.03: LICENSE CLASSIFICATIONS: <br /> <br />c. Outdoor Consumption Endorsement. A special endorsement may be issued by <br />the City to the holder of an on-sale license to allow sales and consumption of 3.2 <br />percent malt liquor outdoors when the outside service area is immediately adjacent <br />to and contiguous with the licensed premises. The licensee shall make application <br />for the special endorsement to the City and pay the annual fee for said <br />endorsement. The special endorsement may be issued by the City Council to the <br />licensee by resolution after a public hearing on the special endorsement is held. <br />The designated outdoor service area shall not reduce the number of off-street <br />parking spaces which would be required if the licensed premises together with the <br />outside service area were to be newly constructed in conformity with the City’s <br />zoning code. The City may also require improvements to the outside service area <br />prior to issuing the special endorsement, including, but not limited to, safety barriers <br />or other enclosures to be placed around the perimeter of the outside service area in <br />order to protect patrons from any hazards, including vehicular traffic. <br /> <br />
