MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION NO. 161-86 <br /> • CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW <br /> PLANNING CASE 168-85, HERBST AND SONS DEMOLITION COMPANY <br /> WHEREAS, Herbst and Sons Demolition Company has requested <br /> City approval for a major subdivision ( 1 lot into 3 lots ) , <br /> rezoning and variance; and <br /> WHEREAS , the Planning Commission has reviewed the staff <br /> report and reviewed information submitted by the applicant; and <br /> WHEREAS, the Planning Commission has also reviewed the <br /> proposal and it is in conformance with all Chapters of the <br /> Municipal Code, specifically Chapters 40 , 42 , 49, and 49A and <br /> State Statutes; and <br /> WHEREAS, the existing building is 5 feet from the property <br /> line, and the City Code requires a 20 foot setback from side yard <br /> lot lines and this is a pre-existing condition not caused by the <br /> property owners; <br /> • NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br /> Planning Commission recommends rezoning the property, occupied by <br /> Herbst and Sons after the subdivision, from B-3 to I-1 ; <br /> BE IT FURTHER RESOLVED that the Mounds View Planning <br /> Commission recommends that the property now occupied by Pettibone <br /> Corporation be rezoned from B-3 to I-1 at the same time; <br /> BE IT FURTHER RESOLVED that the Mounds View Planning <br /> Commission grants a variance of 15 feet on the side yard setback <br /> requirement; <br /> BE IT FURTHER RESOLVED that the Mounds View Planning <br /> Commission recommends revising the Comprehensive Plan for the <br /> Herbst and Pettibone properties; <br /> BE IT FINALLY RESOLVED that the Mounds View Planning <br /> Commission direct staff to forward this resolution to the City <br /> Council prior to approval of the minutes. <br /> Adoped this 7th day of May, 1986 . <br /> ATTEST: <br /> Chairman <br /> (SEAL) <br /> Director of Public Works/ <br /> Community Development <br />
