RESOLUTION NO. 224-88 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION AMENDING PLANNING COMMISSION RESOLUTION NO. 217-88 <br /> DENYING A VARIANCE FOR DYNAMIC DESIGNERS, 7656/7660 WOODLAWN <br /> DRIVE, MOUNDS VIEW PLANNING CASE NO. 138-83 <br /> WHEREAS, Chapter 48 of the Municipal Code sets require- <br /> ments for building within a wetland; and <br /> WHEREAS , Dynamic Designers have requested variances and a <br /> conditional use permit to build two fourplexes within Wetland 1-9 <br /> and the 100 foot buffer; and <br /> WHEREAS, there is a discrepancy between the lot size <br /> scaled off on the site plan dated January 12, 1988, and that of <br /> the Ramsey County records; and <br /> WHEREAS, the existing proposal would require the following <br /> variances : <br /> 1) Waive the minimum lot size for subdivision in a <br /> wetland zoning district. <br /> 2 ) Waive the minimum lot width as measured at the <br /> building setback line for subdividing within a wetland <br /> • zoning district. <br /> 3 ) Waive the requirement that all structures shall be set <br /> back at least 100 feet from a designated wetland. <br /> WHEREAS, the existing proposal also needs a conditional <br /> use permit for filling within a flood plain and a wetland altera- <br /> tion permit to change the wetland boundaries, and <br /> WHEREAS, Staff, City Consultants and the Planning Commis- <br /> sion have extensively reviewed the proposed development; and <br /> - _ - . - - . . • . ' c i pa ogle ' 0 . el u. . 1 , <br /> states the criteria for granting a variance; and <br /> WHEREAS, there are no extraordinary circumstances as <br /> presented which apply to the property which do not apply to other <br /> properties in a wetland zoning district; <br /> NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br /> Planning Commission denies Dynamic Designers' request for a <br /> variance from lot size and lot width requirements in a wetland . <br /> Adopted this 4th day of May, 1988. <br /> 411 ATTEST: <br /> hairm, <br /> (SEAL) <br /> City Planner <br />
