MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION NO. 289-90 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING VARIANCE SETBACK REQUEST BY <br /> KUNZ OIL, 2280 COUNTY ROAD I, PLANNING CASE NO. 295-90 <br /> WHEREAS, the site plan is attached and shown as Exhibit <br /> A and dated April 16, 1990; and <br /> WHEREAS, the Planning Commission has reviewed the <br /> applicant's request for a variance from the side yard setback <br /> to allow the construction of a temporary accessory building on <br /> the site at 2280 County Road I; and <br /> WHEREAS, the accessory building would be used only for <br /> the purpose of housing the contamination clean up equipment; <br /> and <br /> WHEREAS, the building would be removed once the <br /> contamination clean up is completed; and <br /> • WHEREAS, the Planning Commission has reviewed the <br /> criteria used when evaluating all variance requests; and <br /> WHEREAS, the Planning Commission determines that the <br /> requested variance meets the evaluation criteria; and <br /> WHEREAS, the Planning Commission determines that a <br /> situation exists on the property that affects the general <br /> health, safety and welfare of the community. <br /> NOW, THEREFORE, BE IT RESOLVED that the Planning <br /> Commission approves the variance request based on the <br /> following: <br /> 1. The building is temporary in nature. <br /> 2 . Documentation will be supplied to the City from <br /> the Minnesota Pollution Control Agency when the <br /> clean up has been completed. <br /> 3. The clean up will be completed by May, 1993. <br /> 4. If the clean up takes longer than anticipated, a <br /> time extension may be applied for. <br /> 5. The monitor wells will remain in place after the <br /> clean up. <br />
