MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION NO. 322-91 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING THE REQUESTED DRIVEWAY <br /> OPENING VARIANCE FOR PHILLIPS 66 COMPANY, <br /> 2525 HIGHWAY 10, PLANNING CASE NO. 329-91 <br /> WHEREAS, the Mounds View Planning Commission has <br /> reviewed the request of Phillips 66 Company for a variance to <br /> allow a 40 foot driveway opening where only a 30 foot opening is <br /> allowed by Code; and <br /> WHEREAS, the Planning Commission has reviewed the <br /> criteria used when evaluating all variance requests; and <br /> WHEREAS, the Planning Commission has considered that <br /> the reason for the variance request is that the City has <br /> requested a 10 foot easement from the applicant. <br /> NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br /> Planning Commission approves the driveway opening variance <br /> 110 request based on the following: <br /> 1. The condition that exists is not self-created. <br /> 2 . The requested variance is the minimum needed to <br /> alleviate the problem. <br /> 3 . No reasonable alternative for the location of the <br /> driveway opening exists. <br /> BE IT FURTHER RESOLVED that any landscaping not <br /> requiring relocation along Bronson Drive be maintained in its <br /> present condition. <br /> Adopted this 18th day of September, 1991. <br /> ATTEST: <br /> 41/ <br /> ai man <br /> (SEAL) J <br /> /— <br /> Planner <br /> • <br />
