Simon, stated <br /> that he has a party interested in open- <br /> ing a bottle shop, which was what was on <br /> the site prior to it losing its grand- <br /> father rights. Mr. Simon stated that he <br /> had never had parking problems when it <br /> was previously used as a bottle shop. <br /> Planner Harrington confirmed that a <br /> bottle shop is an allowed use on the <br /> property. However, staff has two <br /> concerns regarding the placement of a <br /> new business on the site. The first is <br /> that there is uncontrolled access from <br /> the Groveland Road side of the property. <br /> The second is that Highway 10 right-of- <br /> way is currently being used by the <br /> applicant for parking and vehicle <br /> circulation. If a variance were to be <br /> approved, staff would recommend that a <br /> curbing plan for Groveland Road be <br /> developed and that the applicant be <br /> required to obtain MnDOT approval for <br /> using their right-of-way for parking <br /> purposes. MnDOT has said that they will <br /> study the situation, but ordinarily, <br /> they do not allow their right-of-way to <br /> be used for parking purposes. <br /> Commissioner Stevenson asked why the <br /> east side of the building could not be <br /> used for parking. <br /> Planner Harrington answered that the <br /> area was needed for drive aisles and <br /> general vehicle circulation. <br /> Chair Mountin reminded the Commission <br /> that a variance stays with a property <br /> indefinitely, rather than expiring when <br /> the use. changes. <br /> Commissioner Nelson stated his <br /> uneasiness about granting a permanent <br />
