0 MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION NO. 452-96 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION RECOMMENDING AMENDING CHAPTER 1106 OF THE MOUNDS <br /> VIEW MUNICIPAL CODE ENTITLED "R-1, SINGLE FAMILY RESIDENTIAL <br /> DISTRICT,"PERTAINING TO FOSTER CARE FACILITIES <br /> WHEREAS, the purpose of the Zoning Code is to protect the public health, safety and <br /> welfare of residents of the City; and <br /> WHEREAS, this purpose is accomplished by regulating permitted and conditional uses <br /> within zoning districts; and <br /> WHEREAS, the existing Zoning Code restricts the number, ages of children and the <br /> duration of their stay at a foster care facility; <br /> WHEREAS, the Minnesota Statutes 462.3 57 Subd. 7 allows for a state licensed <br /> residential facility serving six or fewer persons; a licensed day care facility serving 12 or fewer <br /> persons; a group family day care facility licensed under Minnesota Rules, parts 9502.0315 to <br /> 0 9502.0445 to serve 14 or fewer children as permitted single-family uses; and <br /> WHEREAS, the existing Mounds View Zoning Code is in need of modifications to adequately <br /> meet the Minnesota statute requirements; and <br /> NOW, THEREFORE, BE IT RESOLVED that the Planning Commission reco+nmends <br /> modification to the Chapter 1106, Section 1106.02 entitled R-1, Single-Family Residential <br /> District, to include the following permitted uses: <br /> a. A state licensed residential facility serving six or fewer persons; <br /> b. A licensed day care facility serving 12 or fewer persons; <br /> c. A group family day care facility licensed under Minnesota Rules, parts 9502.0315 <br /> to 9502.0445 to serve 14 or fewer children. <br /> d. Residential facilities whose primary purpose is to treat juveniles who have violated <br /> criminal statutes relating to sex offenses or have been adjudicated delinquent on <br /> the basis of conduct in violation of criminal statutes relating to sex offenses shall <br /> not be considered a permitted use. <br /> e. Not withstanding the provision of subdivision 2 of Section 1106.02 herein, foster <br /> family homes as identified in Chapter 9545, Section 6545.0010, Subp. 7 of <br /> Minnesota Rules shall be allowed as permitted uses to serve not more than eight <br /> children per home, not including the foster family's own children. <br /> NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of <br /> 0 Mounds View recommends approval of Ordinance No. 575, an ordinance relating to foster family <br /> homes and amending the Mounds View Zoning Code by amending Chapter 1106, Section <br />
