• Mounds View Planning Commission April 2, 1997 <br /> Special Agenda Meeting Page 2 <br /> 3. <br /> Planning Case No. 471-97 <br /> 2430 Highway 10 <br /> Applicant: Anthony Properties Management, Inc. <br /> Request for a Comprehensive Plan Amendment from Medium Density Residential to <br /> Mixed Use PUD Allowing Commercial and Office Uses, and Rezoning from B-1 and R-2 to <br /> PUD to Allow Development of a 16-Screen Movie Theater and Three 11,000 Square Foot <br /> Office Buildings. <br /> Mr. Wendell Smith, representing the applicant, Anthony Properties Management, <br /> Inc., was present. <br /> Director Sheldon explained that, since the last meeting, further research had <br /> been done on issues that the Planning Commission brought up and a report was <br /> provided to the Planning Commission that divided the issues into two groups: 1) <br /> those issues that had been more or less addressed, and 2) those issues that <br /> were still the subject of discussion. The issues that Staff felt had been resolved <br /> • were the wetland itself and that no construction would occur in it, the proposed <br /> drainage system and the ability of the drainage system to filter the water before <br /> it entered the wetland and its capacity for the amount of water that would occur. <br /> The fact that it was our City Engineer's opinion that there would be no adverse <br /> affect on the existing properties around the site and the existing flooding <br /> problems on the property would not be made worse. The soil conditions were <br /> suitable for development, the vegetation and landscaping proposed would <br /> preserve the tree cover and the specific landscape plan for the developed area <br /> would come in at the next stage. She also discussed the viability of the <br /> proposed office space, economic impact of the project, public safety and the <br /> Fire Marshal's comments. She indicated the Fire Marshal would require a 56 <br /> foot wide access and that an emergency access be available near Donatelle's. <br /> She added that landscaping and screening met the requirements of the Code as <br /> did setbacks, building heights and other applicable zoning issues. <br /> Director Sheldon continued with her Staff Report addressing the unresolved <br /> items. She indicated the Comprehensive (Comp) Plan was inconsistent with the <br /> current zoning and asked if it should be changed. Staffs view was that the <br /> proposed designation was more appropriate for this site than either the adopted <br /> designation or the current zoning, if it is the City's desire to develop the <br /> commercial potential of the Highway 10 corridor and add to its tax base.
