• Mounds View Planning Commission October 1, 1997 <br /> Regular Meeting Page 2 <br /> Associate Ericson briefly reviewed the Planning Commission Memo dated October 1, <br /> 1997 and told the Commissioners the following: Don Leshovsky, owner of the property <br /> located at 2109 Hillview Road, has requested permission from the City to install <br /> temporary parking spaces adjacent to the existing improved parking at the stated address. <br /> Installation of temporary spaces consisting of class 5 gravel would alleviate the parking <br /> problems being experienced. <br /> Associate Ericson referred to the Code: Section 1121.09, Subd. 6, which pertains to <br /> "Grade Elevations." In summary, the Code states that all driveways and parking areas <br /> shall be bituminous, except for temporary surfaces whereby gravel is allowed. <br /> Associate Ericson stated that it was his recommendation that the Planning Commission, <br /> acting as the Board of Adjustment and Appeals, needs to interpret the Code with regard to <br /> gravel parking surfaces in districts other than R-1 and R-2 to determine whether <br /> temporary surfaces would be allowed at 2109 Hillview Road, until such time that the <br /> Code can be rewritten to clarify this reference. <br /> Commissioner Brasaemle stated that in his opinion, because of the reference in the Code <br /> to temporary parking, that it was clear that gravel should be allowed in this case. <br /> Commissioner Johnston expressed his concern that there wasn't enough room at the <br /> specified address to do what the owner has requested. <br /> Chairperson Peterson referred to the sentence of the Code that reads "Parking spaces <br /> and driveways shall be surfaced with materials suitable to control dust, drainage and <br /> erosion, meeting the requirements of Section 902.5 of this Code and shall be installed <br /> within one year following issuance of the building permit," and asked if the class 5 gravel <br /> would meet the intent of the Code because it, too, emits dust. <br /> Associate Ericson stated that the property owner has been sent letters asking him to <br /> address the overflow parking that is taking place on the property's grass side yard. <br /> Commissioner Stevenson stated that the minimum requirement has already been stated in <br /> the Code and class 5 gravel fits that minimum. <br /> Chairperson Peterson stated his concern for setting a precedent for temporary parking in <br /> the R-3 zones. He suggested making a ruling defining a temporary use that would justify <br /> the use of gravel. <br /> Commissioner Obert asked if there would be a time period specified along with granting <br /> of permission to use the gravel surface. <br />
