Signage for the <br /> produce stand will be accomplished with small banners affixed to the stand structure and <br /> lettering on the canvas roof. <br /> According to the City Attorney,the City cannot impose any licensing requirements upon <br /> the applicant. The City can, however, control the time, place and manner of the operation <br /> through a Conditional Use Permit, so long as the requirements do not, in effect, prohibit <br /> the use or impose undue hardship. <br /> Staff is recommending the approval of Planning Commission Resolution 543-98, a <br /> resolution recommending to the City Council that they approve a Conditional Use Permit <br /> for Merryville Farm Market to operate an outdoor produce stand at Moundsview Square <br /> Shopping Center from July 1, 1998 to September 30, 1998, with stipulations. <br /> The stipulations were listed as follows: <br /> 1. The facility shall be allowed to operate from July 1, 1998, to September 30, 1998. <br /> 2. The hours of operation of the facility shall not exceed 8:00 a.m. to 9:00 p.m. <br /> 3. Signage shall be allowed only as affixed to the gazebo base and/or canvas roof. <br /> 4.
