Mounds View Planning Commission March 17, 1999 <br /> Regular Meeting Page 3 <br /> 4. <br /> Planning Case No. 548-99 <br /> 2523 Highway 10 <br /> Consideration of Resolution No. 573-99, a Resolution Recommendation Approval of a <br /> Conditional Use Permit for an Outdoor Flower Mart. <br /> Applicant: Linder's Greenhouses <br /> The applicant was not present. <br /> Planning Associate Ericson reviewed this case explaining that Linder's has received a conditional <br /> use permit for this use at this site for the last five years. He reported that there have been no <br /> problems associated with this use during that time. He went on to say that only two percent of <br /> the parking is used while the City Code requires that accessory outdoor sales and service uses <br /> shall not exceed 30 percent of gross floor area of the principal use. He added that Linders is <br /> about two percent of Mounds View Square, taking up 12 stalls in the parking lot. The flower <br /> mart would operate from about April 15 to July 7. He added that the water for the use is <br /> • obtained from the nearest hydrant and the fees for the water and the appropriate deposits for the <br /> needed equipment are paid to the City accordingly. He added that there has been no impact on <br /> the residential areas. He went on to inform the Commission that Linder's has requested that the <br /> conditional use permit be approved administratively from year to year versus going through the <br /> conditional use permit process each time. He explained that the resolution before them does not <br /> put an expiration date on the conditional use permit, but added that one of the conditions state <br /> that if there are any changes or complaints related to this case, that it would be brought back <br /> before the City for review. He added that the other conditions noted in the resolution are the <br /> same as in previous years and he proceeded to review them. He added that the conditional use <br /> permit would remain in force as long as the conditions are satisfactorily met. He informed the <br /> Commission that Minnesota Statutes indicates that this resolution would be valid. <br /> The Planning Commission made a couple of revisions to the proposed resolution: Item 5, Page 2, <br /> be changed to "....hydrant wrench and adapter valve..."; Item 8, Page 3, be changed by adding <br /> "...be reviewed by the Planning Commission and the City Council..." <br /> Motion/Second: Johnson/Hegland to approve Resolution No.573-99 as amended, Resolution <br /> Recommending to the City Council Approval of the Conditional Use Permit Request by Linder's <br /> Greenhouses, Moundsview Square; Planning Case No. 548-99. <br /> Ayes - 8 Nays - 0 <br /> • Motion Carried. <br />
