MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION NO. 320-91 <br /> 411 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION DENYING VARIANCE REQUEST BY DAHL AND ASSOCIATES <br /> FOR A SIDE YARD SETBACK AT 2901 HIGHWAY 10, <br /> PLANNING CASE NO. 327-91 <br /> WHEREAS, the Mounds View Planning Commission has reviewed <br /> the request by Dahl and Associates for a variance to allow the <br /> placement of a structure at a 5'-0" side yard setback where a 20'-0" <br /> setback is required by Municipal Code; and <br /> WHEREAS, the Planning Commission has reviewed and taken into <br /> consideration the applicant's hardship statement as required for a <br /> variance request; and <br /> WHEREAS, the Planning Commission has reviewed the criteria <br /> for granting a variance per Section 40.26 of the Municipal Code; and <br /> WHEREAS, the Planning Commission has considered alternatives <br /> to the proposed structure location; and <br /> WHEREAS, the Planning Commission determines that there are <br /> reasonable alternatives to the proposed structure location. <br /> NOW, THEREFORE, BE IT RESOLVED that the Planning Commission <br /> of the City of Mounds View denies the variance request by Dahl and <br /> Associates for the following reasons: <br /> 1. The. Planning Commission finds that no hardship exists. <br /> 2 . Reasonable alternatives to the proposal exist. <br /> 3 . The conditions on the property are self-created by the owner <br /> and do not constitute a uniqueness. <br /> BE IT FURTHER RESOLVED that the applicant has the right to <br /> appeal this decision to the Mounds View City Council as allowed for in <br /> Section 40. 26, Subdivisions e and f, of the Mounds View Municipal <br /> Code. <br /> Adopted this 4th day of September, 1991. <br /> ATTEST: <br /> Chairman <br /> (SEAL) <br /> Planner <br />
