MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION NO. 336-92 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING/DENYING SETBACK VARIANCE REQUESTS <br /> BY MAC MAY HOMES, INC. , 2673 SHERWOOD ROAD, <br /> PLANNING CASE NO. 344-92 <br /> WHEREAS, the Mounds View Planning Commission has <br /> reviewed the request of Mac May Homes, Inc. for variances to <br /> construct a single family dwelling at a five foot (5' ) side yard <br /> setback where a ten foot (10' ) setback is required by Municipal <br /> Code and a thirty foot six inch (30'6") front yard setback where <br /> a fifty eight foot (58' ) setback is required by a previous <br /> planning action; and <br /> WHEREAS, the Planning Commission has reviewed the <br /> criteria used to evaluate all variance requests; and <br /> WHEREAS, the applicant has presented a hardship <br /> statement to the Planning Commission; and <br /> WHEREAS, the literal interpretation of the provisions <br /> of this code would/would not deprive the applicant of rights • <br /> commonly enjoyed by other properties in the same district under <br /> the terms of this Code; and <br /> WHEREAS, the special conditions of the property do/do <br /> not result from the actions of the applicant; and <br /> WHEREAS, granting the variance would/would not confer <br /> special privileges on the applicant that are not enjoyed by other <br /> property owners in the same district; and <br /> WHEREAS, the variance requested is/is not the minimum <br /> necessary to alleviate the hardship. <br /> NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br /> Planning Commission approves/denies the variance requests of Mac <br /> May Homes, Inc. for a five foot (5' ) variance into the side yard <br /> setback and a twenty seven foot six inch (27'6") variance into <br /> the front yard setback. <br /> Adopted this 1st day of April, 1992 . <br /> ATTEST: <br /> Chairman <br /> (SEAL) <br /> Planner <br />
