40 . 25 <br /> ( 8) The City Council shall not grant a conditional use <br /> permit until they have received a report and <br /> recommendation from the Planning Commission and the <br /> City staff or until sixty ( 60 ) days after the. first <br /> regular Planning Commission meeting at which the <br /> request was considered . <br /> • <br /> ( 9 ) Upon receiving the report and recommendation of the <br /> Planning Commission and the City staff , the City <br /> Council shall place the report and recommendation on <br /> the agenda for the next regular meeting . Such <br /> reports and recommendations shall be entered in and <br /> made part of the permanent written record of the City <br /> Council meeting. <br /> ( 10 ) Upon receiving the report and recommendation of the <br /> Planning Commission and the City staff, the City <br /> Council shall hold a public hearing and shall make a <br /> recorded finding of fact and shall impose any <br /> conditions it considers necessary to protect the <br /> public health, safety and welfare. <br /> ( 11 ) Amendments of this Code , the official zoning map or a <br /> conditional use permit shall require passage by a <br /> four-fifths ( 4/5) vote of the full City Council . • <br /> ( 12 ) The City Clerk-Administrator shall notify the <br /> applicant of the Council ' s decision in writing . <br /> Subd . B Amendments - Initiation. The City Council or Planning <br /> Commission may upon their own motion , initiate a request <br /> to amend this Code or the official zoning map. Any <br /> person, owning real estate within the City may initiate a <br /> request to amend this Code or the official zoning map as <br /> it affects the real estate owned by said person. <br /> Subd. C Conditional Use Permit. <br /> ( 1 ) Purpose. The purpose of a conditional use permit is <br /> to provide the City of Mounds View with a reasonable <br /> degree of discretion in determining the suitability <br /> of certain designated uses upon the general welfare , <br /> public health and safety. <br /> (2 ) Criteria for Granting Conditional Use Permits. In <br /> granting a conditional use permit, the City Council <br /> shall consider the advise and recommendations of the <br /> Planning Commission and the effect of the proposed <br /> use on the Comprehensive Plan and upon the health, <br /> safety and general welfare of occupants of 411 <br /> surrounding lands. Among other things, the City <br /> Council shall make the following findings where <br /> applicable: <br />
