The regarding variance had previously been denied by variance the Planning Commission. At the City request of Council level, Mr. Simon was directed to Simon T. Simon, obtain an easement from MNDot to use 2840 Highway • some of their right-of-way for parking 10, Planning purposes. Mr. Simon obtained this Case No. 358-92 easement, but it did not grant him much by way of increased parking spaces. Also, the easement agreement contained a clause which allows the agreement to be cancelled by either party with 60 days notice. Since a variance stays with a property forever, the Planning Commission had expressed some discomfort with this easement agreement. Mr. Simon was not in attendance, but had indicated that he wished to have the case proceed forward in his absence.
