Consideration <br /> case, variance request of Simon T. Simon of Resolution <br /> for a reduction in the number of parking No. 362-93 , <br /> spaces required at 2840 Highway 10. The regarding <br /> variance had previously been denied by variance <br /> the Planning Commission. At the City request of <br /> Council level, Mr. Simon was directed to Simon T. Simon, <br /> obtain an easement from MNDot to use 2840 Highway <br /> • some of their right-of-way for parking 10, Planning <br /> purposes. Mr. Simon obtained this Case No. 358-92 <br /> easement, but it did not grant him much <br /> by way of increased parking spaces. <br /> Also, the easement agreement contained a <br /> clause which allows the agreement to be <br /> cancelled by either party with 60 days <br /> notice. Since a variance stays with a <br /> property forever, the Planning <br /> Commission had expressed some discomfort <br /> with this easement agreement. <br /> Mr. Simon was not in attendance, but had <br /> indicated that he wished to have the <br /> case proceed forward in his absence. <br /> Motion/Second: Miller/Peterson to app- <br /> rove Resolution No. 362-93 , reiterating <br /> the stance of the Planning Commission <br /> regarding the request for variance by <br /> Simon T. Simon, 2840 Highway 10. <br /> 6 ayes 0 nays Motion Carried <br /> Planner Harrington reported that a one 8 .
