. <br /> MEMORANDUM <br /> TO: PLANNING COMMISSION <br /> FROM: PAUL HARRINGTON, CITY PLANNER <br /> DATE: November 15, 1993 <br /> SUBJECT: NEW AND USED CAR LOTS - APPLICABLE MUNICIPAL CODES <br /> At the request of the Council, Staff has put together a summary of <br /> the requirements which apply to the establishment of all new and <br /> used car lots located within the City of Mounds View. The <br /> guidelines and their corresponding Chapters in the Municipal Code <br /> are as follows: <br /> Chapter 40 "Zoning" <br /> Allows, as a permitted use, the sale of motor vehicles (both <br /> new and used) within B-3 , Highway Business and, B-4 , Regional <br /> Business Districts. The Chapter goes on to require that any <br /> principal or accessory use whichinvolves open or outdoor <br /> service, sale or rental of merchandise obtain a Conditional <br /> Use Permit for the operation. This requirement applies to <br /> most motor vehicle sales operations and leads to the need for <br /> Conditional Use Permit review. The Conditional Use Permit <br /> review would be subject to the guidelines outlined in Section <br /> 40. 25. <br /> Chapter 59 "Building Permits and Fees" <br /> Section 59. 07 Subdivision (2) requires that all proposed <br /> industrial, commercial and residential developments and <br /> expansion of existing facilities shall be subject to Planning <br /> Commission and City Council review and approval. This <br /> requirement does not apply to expansions of facilities where <br /> public utilities and streets have previously been installed. <br /> These "Development Controls" would be most applicable in the <br /> case of a new development. <br /> Chapter 109 "New and Used Cars" <br /> Chapter 109 covers the licensing of car dealerships within <br /> the City. Specifically, it outlines the criteria which must <br /> be met in order for a license to be granted for the <br /> operation. <br /> Of note is Section 109 . 02 Subdivision 3 which states that the <br />
