411 MEMORANDUM <br /> TO: PLANNING COMMISSION <br /> FROM: PAUL HARRINGTON, CITY PLANNER <br /> DATE: January 21, 1994 <br /> SUBJECT: CONDITIONAL USE PERMIT - OUTSIDE SALES <br /> MOUNDS VIEW SQUARE, PLANNING CASE NO. 372-93 <br /> Peter Linder, representing Linder's Greenhouses, has submitted an <br /> application requesting the approval of a Conditional Use Permit <br /> which would allow the operation of a Flower Mart at *Mounds View <br /> Square. Chapter 40. 19 Subdivision D (2) allows for open or outdoor <br /> sales in a B-4 zoning district with the issuance of a Conditional <br /> Use Permit. The application, as submitted, meets the intent of the <br /> Code in most areas, however, Staff feels that the following issues <br /> should be addressed: <br /> 1) The location of the proposed greenhouse structure is <br /> somewhat close to the intersection of two internal drive <br /> aisles on the property. Staff feels that a visibility <br /> 411 problem could arise creating a potential hazardous <br /> situation for vehicular traffic. Moving the location of <br /> the structure to the East would alleviate this potential <br /> • problem. <br /> 2) The request references the need for electricity on the <br /> site 24 hours per day. Staff assumes the electrical needs <br /> will be provided via the Mounds View Square Center. If <br /> this is indeed the case, Staff would recommend that the <br /> line tying the greenhouse structure to the Center be <br /> overhead and not one that runs across the ground. Staff <br /> has concerns about safety, particularly during hours when <br /> no employees are on the site. The Mounds View Building <br /> Inspector will be referencing the State Electrical Code to <br /> determine minimum heights for overhead electrical lines. <br /> I will provide the Commission with those numbers on <br /> Wednesday evening. <br /> As stated earlier, the request meets the general intent of the Code <br /> and, Staff feels that if the aforementioned issues can be <br /> satisfactorily addressed, the use would not pose any serious <br /> problems. I have included all materials submitted as part of the <br /> application for your review. Please note that the letter of <br /> request outlines proposed hours of operation, number of employees, <br /> etc. <br /> • If you have any questions, please do not hesitate to give me a <br /> call. <br />
