Mounds View Planning Commission August 3 , 1994 <br /> 111 Regular Meeting Page 4 <br /> The applicant, Bruce Bogie, was present. 8 . Consideration <br /> of Resolution <br /> Planner Harrington reviewed the variance No. 398-94 <br /> request by Mr. Bogie. He explained that Regarding <br /> the applicant is requesting a variance Variance <br /> to construct an attached garage with a Request of <br /> setback of 2 feet from the property line Bruce Bogie, <br /> when 5 ' is required by Code. Mr. 2572 Ardan <br /> Harrington explained that the lot was Avenue Planning <br /> subdivided after the construction of the Case No. 390-94 <br /> house which now sets on the lot in an <br /> unique position. <br /> The applicant indicated that he__has <br /> discussed his situation with the <br /> affected neighbor who indicated that he <br /> had no objections . <br /> Commissioner Stevenson informed the <br /> Commission that he made a site <br /> inspection of the property and also <br /> spoke with the neighbor in question who <br /> indicated that he is opposed to the 2 ' <br /> setback request. Mr. Stevenson also <br /> demonstrated that if the garage was <br /> constructed, the Lilac bushes now <br /> existing on the west side of the garage <br /> would need to be cut in order to walk on <br /> that side. <br /> The driveway code was mentioned by the <br /> Planning Commission which requires that <br /> written permission be obtained by an <br /> adjaccnt property owner for construction <br /> of a (temporary) driveway closer than 5 <br /> feet to the property line but not less <br /> than one foot. It was also noted that a <br /> concrete driveway could be not closer <br /> than 5 feet to the property line. <br /> The Commission briefly discussed <br /> alternative locations for the garage on <br /> the lot. (It was also noted that the <br /> property was subdivided prior to <br /> adoption of the setback ordinance. ) The <br /> applicant informed the Commission that <br /> it would not be practical to have the <br /> 411 garage on the other side of the house. <br />
