• MEMORANDUM <br /> TO: PLANNING COMMISSION <br /> FROM: PAUL HARRINGTON, COMMUNITY DEVELOPMENT COORDINATOR <br /> DATE: August 15, 1994 <br /> SUBJECT: VARIANCE, 5299 CLIFTON DRIVE <br /> LARRY AND SUSAN POTTS, PLANNING CASE NO. 394-94 <br /> Larry and Susan Potts have made application for a variance to allow <br /> the construction of an addition to their home which will be four <br /> (4) feet from an existing garage also located on the property. <br /> Chapter 1106. 03 Subdivision 1 (c) of the Mounds View Municipal Code <br /> states in part that no accessory building shall be closer than. six <br /> (6) feet from any other building or structure on the same lot. <br /> I have checked with the Mounds View Building Inspector and found <br /> that the Uniform Building Code (UBC) - which is adopted by <br /> reference in the Municipal Code - allows for structures on the same <br /> lot to be located at less than a six (6) foot setback with proper <br /> IIIfireproofing of walls. However, because the Municipal Code <br /> specifically lists the six (6) foot setback requirement, a variance <br /> would be necessary for the construction of the addition as <br /> proposed. <br /> I have included all materials received as part of this application <br /> for your review. <br />
