MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION NO. 399-94 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING A MINIMUM BUILDING SEPARATION VARIANCE <br /> AT 5299 CLIFTON DRIVE, PLANNING CASE NO. 394-94 <br /> WHEREAS, the Mounds View Planning Commission has <br /> reviewed the request of Larry and Susan Potts for a variance to <br /> allow a reduction in the minimum building separation at 5299 <br /> Clifton Drive; and <br /> WHEREAS, the Mounds View Municipal Code requires that <br /> all structures be separated by a minimum of six (6) feet; and <br /> WHEREAS, the applicant's request for variance would <br /> allow construction of an addition to their single family home <br /> which would be four (4) feet from an existing detached garage; <br /> and <br /> WHEREAS, the Planning Commission has reviewed the <br /> criteria used to evaluate all variance requests; and <br /> • WHEREAS, the Planning Commission has determined that no <br /> reasonable alternatives for the location of the house addition <br /> are available; and <br /> WHEREAS, the variance requested is the minimum <br /> necessary to alleviate the hardship; and <br /> WHEREAS, the Uniform Building Code allows structures <br /> closer than six (6) feet to one another with proper installation <br /> of fire walls. <br /> NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br /> Planning Commission approves the request of Larry and Susan Potts <br /> for a variance to allow a four (4) foot setback between <br /> structures on their property contingent upon the following: <br /> 1. All applicable regulations contained in the Uniform <br /> Building Code relating to fireproofing of walls shall be <br /> adhered to. <br /> Adopted this 7th day of September, 1994 . <br /> ATTEST: <br /> Chairman <br /> • (SEAL) <br /> Community Development Coordinator <br />
