• MEMORANDUM <br /> TO: PLANNING COMMISSION <br /> FROM: PAUL HARRINGTON, COMMUNITY DEVELOPMENT COORDINATOR <br /> DATE: July 12, 1995 <br /> SUBJECT: VARIANCE REQUEST - 7305 KNOLLWOOD DRIVE <br /> LARRY BEACH, PLANNING CASE NO. 416-95 <br /> Larry Beach has made application for a variance on the property <br /> located at 7305 Knollwood Drive. In May of this year, the <br /> applicant applied and received approval for a zero lot line <br /> subdivision of the subject property in order to build four (4) <br /> owner occupied townhomes. Within the past month, while submitting <br /> building plans for the townhomes, the applicant discovered that <br /> enclosed porches he wished to construct on the back of three (3) of <br /> the units encroached upon the City defined rear yard setback. <br /> Specifically, the porches encroached six (6) to seven (7) feet into <br /> the required rear yard setback. <br /> • Because of this, Mr. Beach has made application for a variance for <br /> the three (3) porches. The fourth unit will simply have a deck <br /> which the code defines as being exempted from setback requirements <br /> down to a minimum of two (2) feet. In speaking with the applicant, <br /> he has expressed a hardship in that the original platting of the <br /> property, that being prior to his ownership and subsequent further <br /> subdivision, laid out lot lines which were not square and therefore <br /> cause problems in locating structures on the parcel. The location <br /> of the proposed townhomes are as far forward on the lots as is <br /> allowed by Municipal Code, and the alternatives for the applicant <br /> seem to be somewhat limited. <br /> I have included with this memorandum all materials received as a <br /> part of this application for your consideration. <br /> • <br />
