1-1 <br /> ZONING ORDINANCE <br /> SECTION 300 . 29 <br /> PAGE 232 <br /> • <br /> SECTION 300. 29 . NON-CONFORMING USES. <br /> SUBDIVISION 1. PURPOSE. It is the purpose of this section to <br /> accomplish the following: <br /> a) recognize the existence of uses which were lawful when <br /> established but which no longer meet all ordinance <br /> requirements; <br /> b) discourage the enlargement, expansion, intensification or <br /> extension of any non-conforming use or any increase in the <br /> impact of a non-conforming use on adjacent properties; and <br /> c) encourage the elimination of non-conforming uses or reduce <br /> their impact on adjacent properties. <br /> 4/Z <br /> SUBDIVISION 2 . DEFINITIONS. For the purposes of this section, the <br /> following terms and phrases shall have the meanings given to them: <br /> s <br /> a) legal non-conformity: any land use, structure, physical formAttif <br /> of land development, lot of record or sign legally established -40 <br /> prior to the effective date of this ordinance or subsequent <br /> 411 amendment to it which would not be permited by or is not in <br /> full compliance with the regulations of this ordinance. A <br /> legal non-conformity shall be one of four types: <br /> non-conforming land use, • non-conforming lot of record, <br /> non-conforming sign or non-conforming development. <br /> b) non-conforming land use: an activity using land, buildings, <br /> and/or structures for purposes which were legally established • <br /> prior to the effective date of this ordinance or subsequent <br /> amendment to it and which_.the regulations o.f_this ordinance or <br /> . - .1 - • _ .. - - <br /> new use in the zone in which it is located. <br /> c) non-conforming lot of record: a lot or parcel of land legally <br /> created and duly recorded in the office of the county recorder <br /> or registrar of titles prior to the effective date of this <br /> ordinance and which does not meet the minimum area or <br /> dimension requirements of this ordinance. <br /> d) non-conforming sign: a sign which was legally established <br /> prior to the effective date of this ordinance which would not <br /> • be permitted to be established by the terms of section 300. 30 , <br /> . et seq. of the code of city ordinances . <br />
