MEMORANDUM • <br /> TO: PLANNING COMMISSION <br /> FROM: JOYCE PRUITT, PLANNING ASSOCIATE <br /> DATE: JANUARY 10, 1996 <br /> SUBJECT: CHURCH UPON THE ROCK, 7901 RED OAK DRIVE,EXTENSION OF <br /> ' A CONDITIONAL USE PERMIT TO ALLOW FOR THE CONTINUED <br /> USE OF A TEMPORARY STRUCTURE ON RESIDENTIALLY ZONED <br /> PROPERTY,PLANNING CASE NO. 436-95 <br /> Church Upon the Rock, 7901 Road Oak Drive, has made application for an extension of a <br /> previously approved Conditional Use Permit to allow for the continued use of a temporary <br /> accessory structure. In April, 1988, the City Council approved Resolution No. 2320 for a <br /> temporary classroom structure. The Resolution allowed use of the temporary structure for a <br /> five-year period from the date of adoption. A sunset clause requiring removal of the temporary <br /> structure and placement of a permanent structure in its place and a contingency requiring the site <br /> and building to be brought up to code after the five-year time period were included in Resolution <br /> No. 2320. <br /> The following is a summary of action taken regarding this case. • <br /> DATE ACTION <br /> April 25, 1988 City Council approved Resolution No. 2320 for a <br /> Conditional Use Permit for a temporary structure for <br /> Church Upon the Rock. This Resolution provided a <br /> sunset clause of five years in the contingency"After <br /> the five-year time period, the temporary structure is <br /> to be removed and a permanent structure put in its <br /> place requiring the site and building to be brought <br /> up to Code, pending approval by the City Council. <br /> June 13, 1988 City Council approved Resolution Na. 2341 for a <br /> Special Use Permit to maintain a church and <br /> elementary school with an R-1 District at 7901 Red <br /> Oak Drive. This Resolution included a contingency <br /> of one student to 30 square feet ratio for the <br /> temporary classroom building. <br /> September 13, 1993 City Council approved Resolution No. 4409, <br /> granting a one-year extension(until July 1, 1994) of <br /> the CUP for a temporary accessory structure. <br />
