Staff believes that the substitute amendment meets these guidelines but <br /> that the proposal could not become significantly more restrictive <br /> without endangering the City's conformance to the.guidelines. First, <br /> • the available land mass is 6.5% of the city's total, comfortably above <br /> the 5% standard. However, a significant part of this percentage is <br /> devoted to the airport and the waste water treatment plant, uses which <br /> are not likely to be redeveloped in the foreseeable future. Secondly, <br /> the available land includes sites with fairly good development <br /> potential. However, if the required distance to "protected uses" were <br /> significantly expanded, few such sites would remain. Finally, the <br /> "relative site capacity" of 28 exceeds the number of existing adult uses <br /> in Saint Paul (18) . However, because two of Saint Paul's existing adult <br /> uses are multi-functional facilities (with 3 or 4 types of adult uses <br /> per business) , it is preferable to calculate the existing number of <br /> adult uses to be 24. Thus, it is not advisable to make the ordinance <br /> more restrictive in a way that would reduce the city's relative site <br /> capacity for adult uses. <br /> 8. Review of the Special Condition Use Permit <br /> EXPLANATION: The substitute amendment requires an annual review of each <br /> adult use's Special Condition Use Permit. The Zoning Code currently <br /> requires that an adult use obtain a Special Condition Use Permit but <br /> does not provide for an annual review. <br /> RATIONALE: Because the substitute amendment requires that there be only <br /> one type of adult use. per building, the annual review of the Special <br /> Condition Use Permit will ensure that no- additional uses are added to <br /> the type of adult use that is permitted. <br /> 9. Prohibition of Obscene Works and Illegal Activities <br /> EXPLANATION: In numerous places, the substitute amendment stipulates <br /> that obscene and illegal activities are not permitted in adult uses. <br /> This is not explicitly stated in the Zoning Code currently. <br /> RATIONALE: This provision is intended to guard against the conclusion <br /> that the Zoning Code permits activities which the City can and should <br /> prohibit as illegal. <br /> i <br /> 9 <br />
