16 • <br /> City, the code, rule or regulation which imposes the more restrictive condition, <br /> standard or requirement shall prevail. (1988 Code §§ 39.14) <br /> 1008.10 VIOLATION OF PROVISIONS: <br /> a. Any person found violating any of the provisions of this Chapter shall be guilty of <br /> a misdemeanor. (1988 Code §§ 39.15) <br /> b. REMOVAL OF ABANDONED OR ILLEGAL SIGNS: <br /> 1. The City Clerk-Administrator, or his/her designee, may order the removal of <br /> any sign erected or maintained in violation of this ordinance. Ten (10) days <br /> notice in writing shall be given to the owners of such sign, or the owner of the <br /> building, structure or premises on which such sign is located, to either bring <br /> the sign into compliance with this ordinance, or effect its removal. Upon <br /> failure to remove the sign or to comply with this notice, the City Clerk- <br /> Administrator, or his/her designee, shall remove the sign. The City may not <br /> be held liable for any damage to an impounded sign. The City shall remove <br /> the signs immediately and without notice if it reasonably appears that the <br /> condition of the sign is such as to present an immediate threat to the safety of <br /> the public. Any cost of removal incurred by the City shall be assessed to the • <br /> owner of the property on which such sign is located or may be collected in <br /> appropriate legal proceedings. <br /> 2. The City, at any time and without notice, may order the immediate <br /> impoundment of signs which have been installed on public property, within a <br /> public right-of-way or within a public easement. <br /> 3. The City shall have no obligation to notify a property owner that it has an <br /> impounded temporary sign. <br /> 4. Payment of Impoundment Release Fee. Any subsequent impoundments(s), <br /> within one calendar year,for a particular property will require payment of <br /> double the initial impoundment fee. <br /> 5. Any impounded sign must be retrieved from the impound areas within 30 days <br /> of the impoundment or the City will dispose of it. <br /> • <br />
