The variance expired one <br /> year from the date of issuance, or March 18, 1993. <br /> To consider this request, the Planning Commission <br /> would first need to consider whether to grant an extension to <br /> the variance request issued in March 1992. Then, if the <br /> variance is granted, then a development review process <br /> would be appropriate. <br /> The City Engineering Consultant, SEH, has reviwed this site <br /> plan and found that the site expansion should have no <br /> negative impacts on the drainage system. Although it will <br /> slightly increase the runoff rate, the area was assumed to be <br /> all developed in the LWMP. This proposal does not require <br /> Rice Creek Watershed District approval, as the site is only <br /> 1.68 acres in size. <br /> Based on the discussion at the June 19, 1996 agenda <br /> meeting, the parking provided appears to be adequate for <br /> the site. <br /> Recommendation/ <br /> Analysis: Based on the discussion generated at the June 19, 1996 <br /> Agenda meeting, Resolution No. 458-96, for approval of the <br /> variance extension, has been prepared for your review and <br /> consideration with the following contingency: <br /> 1. Whenever, within one year after granting a variance <br /> or appeal, the work as permitted by the variance or <br /> appeal shall not have been completed, then such <br /> variance or appeal shall not become null and void <br /> unless a petition for extension of time in which to <br /> complete the work has been granted by the Board of <br /> Adjustment and Appeals. <br /> Resolution No. 459-96, recommending approval of the <br /> development review request has also been prepared for <br /> your review and consideration, with the following <br /> contingency: <br /> 1) Herbst and Sons enter into a development agreement 11111 <br />
