She added that the variance was to Drive, Planning Case
allow construction of an addition to their No. 450-96
existing facility at a thirty-foot rear yard setback
where a forty-foot setback is required by
Municipal Code. Acting Director Pruitt went on
to explain that if Resolution No. 456-96 is
approved, she would recommend placing a
contingency in the resolution that if the work is
not completed within one year the variance
would be null and void unless an extension is
granted by the Board of Variances and
Appeals.
Mr. Greg Kelly, a representative for Bioclean,
explained that no cleaning occurs on site and
the operation is mobile in nature.
• Commission Brasaemle suggested that •
Resolution No. 456-96 state, "WHEREAS, on
July 5, 1995, the Planning Commission
adopted Resolution No. 420-95 granting the
variance."
Director Pruitt explained that if the variance
was approved by the Planning Commission it
would be a completed process and would not
be forwarded to the City Council.
The Planning Commission discussed with the
represenative that the industry has until August
15 to ensure that wash water does not enter
into the storm sewer. The applicant notified the
Planning Commission that they are the only
mobile wash company which uses a vacuum
system which prohibits water from going down
the sewer system for customers who request it.
The applciant then explained they are now
required by federal law to prevent wash water
from entering into the storm sewer.
