• <br />4) ALLOW ANTENNAE ON LANDMARKED BUILDINGS <br />Revised language allows installation on lanthnarked buildings after issuance of a landmark <br />alteration certificate, as per industry request <br />5) CHANGE EXACTION TO A FEE INSTEAD OF IN -KIND SERVICES. LIMIT FEE <br />TO THREE YEARS. <br />The ordinance incorporates the change from in -kind services to a fee. <br />Staff believes that an annual fee of $2,000 per base starionlper year is justifiable as an on- <br />going fee. However, staff is undertaking a review of our telecommunications occupation tax <br />structure, and, at such rime as the voters approve a revised occupation tax, this fee would no longer <br />be needed and could be repealed.. <br />QUESTION #6 -- USE OF CITY POLES? <br />(Councilman Havlick) <br />Concerned about liability and restrictions related to use of City utility poles. Wants free <br />standing antennae to be "not permitted" instead of "not recommended" <br />RESPONSE: <br />The current language in the ordinance does not allow attachment to utility poles and does <br />not permit free-standing antennae. <br />QUESTION #7 — TERMS OF THE EXACTION? <br />(Councilman Havlick) <br />Wants better explanation of the exaction — should be some kind of compensation that <br />benefits the average citizen. <br />(Councilman Myre) <br />Would prefer straight fee instead of phones <br />RF.SPONSF. <br />In response to indzZ7y concerns, the value requested has been changed to a fee as opposed <br />to a fee or in -kind option. <br />The proposed ordinance requires all wireless telecommunications services vendors to pay <br />to the City a permit fee of $2,000 per year / per base station, as compensation for costs to the City <br />in revising the zoning code, monitoring compliance, and updating —City telecommuzTicanspolicy — — <br />as may be required by future technological or regulatory developments. <br />Fees collected under this ordinance will be paid into the City Technology Fund for use in <br />developing improved internal communications resources that will, in turn, help the City to provide <br />better City service to the public. <br />The City Manager has directed staff to undertake a comprehensive review of the City' s <br />telecommunications occupation tax structure, and to recommend to Council a possible ballot item <br />that would extend this tax in a nondiscriminatory manner to all telecommunications providers. At <br />such time as a revised occupation tax is passed by the voters, "technology -specific" fees such as the <br />wireless telecommunications services fee will no longer be necessary and can be repealed. <br />AGENDA ITEM # Page 4 <br />
