The <br /> applicant wishes to increase the number of stalls in order to <br /> meet the demands of a tenant that may locate to the <br /> business park. The total parking stalls provided on the site <br /> will total 500 parking stalls. As the plans indicate, the <br /> parking spaces located on the east side of the property will <br /> abut the property line. The Municipal Code addresses the <br /> importance creating a landscaping buffer from parking lot to <br /> property line in Section 1121.09, Subd. 11. The Planning <br /> Commission has agreed to allow parking up to the property <br /> line for this PUD development since a landscaping buffer is <br /> being provided within the right-of-way. <br /> The parking area to the south of the building will be <br /> restriped. <br /> Staff is researching with Attorney Long whether a <br /> • conditional use permit and public hearing will be required for <br /> the amendment. Staff anticipates bringing an opinion from <br /> the Attorney to the Agenda Meeting. <br /> The applicant is also requesting that the plans submitted be <br /> accepted as the general concept plan and the final plan to <br /> expedite the process of amending the PUD. <br /> Rick Wriskey, City Forester, has requested the existing <br /> trees be moved within 8'-9' from the curb along the right-of- <br /> way. The applicants at the Agenda Meeting agreed to look <br /> into this option. Staff recommends adding a continency that <br /> a landscaping plan be submitted and approved by the City <br /> Forester. <br /> The applicant has been advised that the amendment will <br /> require Rice Creek Watershed District approval. A <br /> contingency may be added to the development review <br /> requiring this approval. <br /> Attorney Long has advised that a public hearing will be <br /> required to amend the PUD agreement. <br /> • <br />
