8370 Pleasant View Drive CUP Report <br />April 25, 2005 <br />Page 2 <br /> <br />Staff contacted the Mounds View Police Department and requested any complaints or <br />reports filed regarding animals at the subject property. There is one complaint on file with <br />the Police Department for 8370 Pleasant View Drive. On March 5, 2005, the Police <br />Department received a complaint about barking dogs at the residence. Because the <br />applicant moved to Mounds View just a few months ago, Staff also contacted the City of <br />West St. Paul, where the applicant previously resided. The Police Department in West <br />St. Paul had no reports or complaints regarding animals for the applicant or her previous <br />residence. <br /> <br />CUP Considerations: <br /> <br />Conditional Use Criteria <br /> <br />In granting a conditional use permit, the City Council shall consider the advice and <br />recommendations of the Planning Commission (see “Adverse Effects” on page 3), and the effect <br />of the proposed use on the Comprehensive Plan and upon the health, safety and general <br />welfare of occupants of surrounding lands. Among other things, the City Council shall make the <br />following findings where applicable: <br /> <br />(1) The use will not create an excessive burden on existing parks, schools, streets and other <br />public facilities and utilities which serve or are proposed to serve the area. <br /> <br />The proposed residential kennel would cause none of these identified problems. <br /> <br />(2) The use will be sufficiently compatible or separated by distance or screening from adjacent <br />residentially zoned or used land so that existing homes will not be depreciated in value and there <br />will be no deterrence to development of vacant land. <br /> <br />The applicant’s property will be fenced in and having pets is a common situation in <br />residential areas. The proposed use should not cause depreciation in value of the <br />neighboring properties. <br /> <br />(3) The structure and site shall have an appearance that will not have an adverse effect upon <br />adjacent residential properties. <br /> <br />The rear yard of the applicant’s property will be entirely fenced in. The property appears <br />similar to all other residential properties and the site should not have an adverse effect <br />upon the adjacent properties. The concern that has been pointed out by the neighbors, is <br />that if the dogs bark excessively, it would cause a nuisance to the adjacent properties. <br /> <br />(4) The use, in the opinion of the City Council, is reasonably related to the overall needs of the <br />City and to the existing land use. <br /> <br />Dog ownership is fairly common in residential neighborhoods. <br /> <br /> <br />
