He 2 <br />stated that this is the only option available to them to gain viable space, as they are landlocked 3 <br />and not able to move to further south. 4 <br /> 5 <br />Council Member Stigney stated that they could not support the request if there are no other 6 <br />options available to consider. He stated that the Planning Commission has reviewed and 7 <br />determined that none of the criteria has been met to justify the hardship. 8 <br /> 9 <br />Mayor Marty asked the applicant how long they have been at this location and if their business 10 <br />has grown considerably, which is the reason for this request. 11 <br /> 12 <br />Mr. Hasselbrack stated that they have been at this location since 1999 and confirmed that they 13 <br />have grown some since that time. He stated that they have been dealing with the problem since 14 <br />1999 and would like to have it resolved. 15 <br /> 16 <br />MOTION/SECOND Stigney/Gunn To approve the Planning Commission’s recommendation 17 <br />for denial of Resolution 6544 for Ace Supply Company’s request for a variance appeal to reduce 18 <br />the front parking setback to zero feet primarily on the basis that the application does not meet the 19 <br />criteria for improvement. 20 <br /> 21 <br /> Ayes - 3 Nays - 1 (Gunn) Motion carried. 22 <br /> 23 <br />D. Resolution 6537, Approving the Acquisition of Tax Forfeited Property for 24 <br />Purposes of Stormwater Management. 25 <br /> 26 <br />Director Ericson stated that the City received notification from Ramsey County on two forfeited 27 <br />parcels located in the northwest part of the City. He stated that a map of the area is attached for 28 <br />Council review noting that one parcel is a legal, developable lot and the other is an Outlot 29 <br />intended for stormwater management. He stated that Staff is recommending that the City acquire 30 <br />the parcels. He stated that the pond does go over the property line into a triangular lot not that 31 <br />the City does have easements on the lot. He stated that Staff is recommending that the City 32 <br />acquire use of the deeds for these two lots and send letter to Ramsey County indicating the desire 33 <br />in order to alleviate any potential disputes that these two parcels could be developed. 34 <br /> 35 <br />Mayor Marty clarified that the parcels would be owned by Ramsey County. 36 <br /> 37 <br />Director Ericson confirmed that the parcels would continue to be owned by the State, Ramsey 38 <br />County would manage the taxes and would be allowed to use the property. He indicated that he 39 <br />spoke with the County and it is his understanding that the fees would be less than $300. 40 <br /> 41 <br />Mayor Marty agreed that as they begin to redo and fix the roads there would be a need to contain 42 <br />the water and since these sites are already being used in an unofficial way to retain water it would 43 <br />seem to be a good idea for the City to retain the control of these parcels. 44 <br /> 45
