Public Notification <br /> 40 <br /> Most local governments have standard public notification requirements contained'in their zoning <br /> regulations. As part of the discretionary review process, public notice is required to be provided to <br /> all property owners located within a given radius of the project site (a 300 foot radius is typical). In <br /> addition, most jurisdictions require the posting of a public notice at designated public sites (such as <br /> City Hall or libraries), publishing a public notice in a paper of general circulation, and/or posting a <br /> notice on the project.site. Public notice is usually required only for those projects which require a <br /> public hearing,and is not required for projects subject to administrative review. The intent of public <br /> notification is to give local citizens, organic tions, and other jurisdictions reasonable notice and <br /> opportunities for input into the permit review process. <br /> • <br /> For sites located adjacent to coastal regions, additional noticing requirements may be imposed by <br /> the state's California Coastal Act provisions. For jurisdictions without the approved Local Coastal <br /> Plans (LCPs), coastal development permits (another type of discretionary permit) are required to be <br /> forwarded to the California Coastal Commission for approval, which requires that public notice is <br /> provided to renters, as well as property owners, within a specified radius of the project site. <br /> • <br /> Time Limitation <br /> Some jurisdictions have determined it appropriate to place time limitations on discretionary permits <br /> for wireless communications facilities. Time limits are typically an issue because of concerns about <br /> the facilities' perceived ,effects on health (given inconclusive.health studies), and because of the <br /> unknown impact of future technology on the wireless communications industry. For example, the <br /> City of Chula Vista includes conditions that require subsequent discretionary review, and which <br /> enable the City to modify or add conditions of approval, or to revoke.a permit. One condition, that <br /> relates to EMF health concerns, requires the submittal of a report which.,provides quantified EMF <br /> field measurements and compares those measurements to current ANSI standards. If the project <br /> does not meet ANSI standards, the discretionary permit may be modified or revoked. Chula Vista <br /> also includes another condition that reserves the right of the City to add, modify, or delete <br /> conditions after the approval of a permit in order to "advance a legitimate governmental interest <br /> relate to_health,-safetyor welfare,."
