Public Hearing: Upon receiving the report and recommendation of the <br /> Planning and Zoning Commission and the City� staff, the City Council <br /> shall hold a public hearing in compliance with Minnesota Statutes section <br /> 462.357, subdivision 3 and shall make a recorded finding of fact and shall <br /> impose any conditions it considers necessary to protect the public health, <br /> safety and welfare. <br /> j. Four-Fifths Vote: Amendments of this Title, the Official Zoning Map or <br /> a conditional use permit shall require passage by a four-fifths (4/5) vote of <br /> the full City Council. <br /> k. Notification of Decision: The City Clerk-Administrator shall notify the <br /> applicant of the Council's decision, in writing. <br /> Subd. 2. Initiation of Amendments: The City Council or Planning and Zoning <br /> Commission may, upon its own motion, initiate a request to amend this <br /> Title or the Official Zoning Map. Any person owning real estate within <br /> the City may initiate a request to amend this Title or the Official Zoning <br /> Map as it affects the real estate owned by said person. <br /> Subd. 3. Conditional Use Permit: <br /> • a. Purpose: The purpose of a conditional use permit is to provide the City <br /> with a reasonable degree of discretion in determining the suitability of <br /> certain designated uses upon the general welfare, public health and safety. <br /> b. Criteria for Granting Conditional Use Permits: In granting a conditional <br /> use permit, the City Council shall consider the advice and <br /> recommendations of the Planning..and Zoning Commission and the effect <br /> of the proposed use on the Comprehensive Plan and upon the health, <br /> safety and general welfare of occupants of surrounding lands. Among <br /> other things, the City Council shall make the following findings where <br /> applicable: <br /> (1) The use will not create an excessive burden on existing parks, <br /> schools, streets and other public facilities and utilities which serve or are <br /> proposed to serve the area. <br /> (2) The use will be sufficiently compatible or separated by <br /> distance or screening from adjacent residentially zoned or used land so <br /> that existing homes will not be depreciated in value and there will be no <br /> deterrence to development of vacant land. <br /> (3) The structure and site shall have an appearance that will not <br /> have an adverse effect upon adjacent residential properties. <br /> • <br /> City of Mounds View <br />
