Mounds View Planning Commission August 7, 1996 <br /> • Regular Meeting Page 15 <br /> when the applicant wants occupancy of the <br /> building, the items are not completed, the City <br /> would decide if it would allow security to be <br /> posted and occupancy permits to be issued, or <br /> require that the improvements be completed. <br /> Right now the City requires that the applicant <br /> put up security before construction is started, <br /> when the usual practice is to construct private <br /> improvements along with construction of the <br /> building. There are occasions when <br /> improvements such as landscaping cannot be <br /> completed because of whether until the next <br /> growing season. In these situations, security <br /> could be required for installation of the <br /> landscaping and an occupancy permit issued. <br /> For public improvements, development <br /> contracts and security are needed for such <br /> • improvements as sidewalks, curb and gutter, <br /> streets, etc., and no change is proposed in this <br /> requirement. She expressed that development <br /> contracts are not needed for proposals such as <br /> oversized garages. Resolution No. 470-96 <br /> talks about making these minor items exempt <br /> because no other improvements are involved. <br /> It was requested by the Planning Commission <br /> that Resolution No. 470-96 be amended to <br /> state that the Planning Commission <br /> recommend and the City Council grant waivers <br /> when such contracts are not needed to fulfill <br /> the requirements of the ordinance, rather than <br /> exempted certain situations. The Planning <br /> Commission discussed that there are some <br /> cases when the construction of an oversized <br /> garage involves removal of other structures and <br /> then a development contract and security is <br /> needed. <br /> Motion/Second: Miller/Brasaemle to table the <br /> consideration of Resolution No. 470-96 <br /> • regarding Ordinance No. 588 amending the <br /> development contract language of chapter <br />
