Item #10 <br /> SII <br /> PLANNING COMMISSION • <br /> MEMO <br /> To: Mounds View Planning Commission <br /> From: Pamela Sheldon, Community Development Director <br /> Subject: Setbacks for Parking Lots for Non-Residential Uses <br /> Planning Case No. SP-008-96 <br /> Date: September 11, 1996 <br /> Meeting on September 18, 1996 <br /> Issue <br /> Mr. Danny D. Moon, a property owner in Mounds View, has requested the the Zoning Code be <br /> amended to require a minimum 15 foot setback between parking lots and property lines for <br /> churches and any commercial uses, when these uses are adjacent to residential uses (see attached <br /> letter). <br /> Recommendation • <br /> Discuss the proposal presented in this staff report and in the draft of Ordinance 590 which would <br /> amend the Mounds View Zoning Code, Title 1100, Sections 1101.01, 1104.01, 1106.04, <br /> 1121.09, 1121.11, and 1123.02 Relating to Setbacks for Parking Lots, Driveways, and Principal <br /> and Accessory Buildings, and the Continued Use of Non-Conforming Parking Lots. <br /> Make a recommendation to City Council no later than October 9, 1996 for at least that portion of <br /> the Code revision requested by Mr. Moon, i.e. increase in setbacks from five feet to fifteen feet <br /> for parking lots fzor pure hes and commercial uses adjacent to residential uses. <br /> Background/Analysis <br /> 60-Day Rule: Mr. Moon's request was submitted after the August 7th Planning Commission <br /> meeting. (The letter is not dated.) Staff has asked the City Attorney whether the 60-day rule <br /> applies to requests from property owners to change the text of the Zoning Code. His response <br /> was that it is not clear nor has it been litigated. In order to be prudent, we should proceed as if the <br /> 60-day rule does apply. The first 60 day period would expire on October 5; an extension for an <br /> additional 60 days would expire on December 4. In order for staff to have this item before City ' <br /> Council for action prior to December 4, the Planning Commission needs to forward its <br /> • recommendation to City Council no later than October 9. This schedule allows discussion of this <br /> item by the Planning Commission at this meeting (September 18), and at your meetings in <br /> October (2nd and 9th). The Planning Commission could separate that portion of the ordinance <br />
