PLANNING CASE NO. 466-96 <br /> November 14, 1996 <br /> • <br /> Page 2 <br /> Background: <br /> This minor subdivision does not create an additional lot but instead takes a 12 '/2 foot wide <br /> strip of land from one lot and adds it to the adjoining lot to the north. This action would <br /> formalize a previous agreement made with the property owner to the north and Mr. Beach. <br /> The property owner to the south was informed of this impending action prior to the <br /> purchase of 7532 Silver Lake Road. Because drainage and utility easements have already <br /> been recorded for the existing configuration of the two lots, they will need to be amended in <br /> such a way that vacates the old side lot easement between the two properties and creates a <br /> new ten(10) foot wide easement centered on the revised side lot property lines. <br /> Documents describing the vacated and new easements shall be provided by the applicant <br /> and verified by the City Attorney and staff prior to your meeting on December 4. <br /> Analysis: <br /> The minimum square footage for lot area required by the Code is 12,500 feet. The <br /> properties currently well exceed that requirement with 20,853 square feet for the property <br /> to the north and 26,075 square feet for the property to the south. After the re-subdivision, <br /> the properties will remain in compliance with this requirement with 23,460 square feet for <br /> the property to the north and 23,468 square feet for the property to the south. Currently, IP <br /> the properties meet or exceed the minimum lot width requirement (100 feet for the <br /> northerly property and 125 feet for the southerly property.) After the re-subdivision, the <br /> width of the properties will be 112.5 feet for both. <br /> The applicant has provided a revised Certificate of Survey for the properties located at <br /> 7540 and 7532 Silver Lake Road. This revised Certificate of Survey shows the property <br /> lines and easements as revised with the former property lines and easements in the <br /> background. The revised lots have been labeled as Parcel X(7540 Silver Lake Road) and <br /> Parcel Y (7532 Silver Lake Road.) The Certificate of Survey includes the revised legal <br /> descriptions for both parcels, as well as their former descriptions. <br /> Recommendation: <br /> Staff is favorable toward the approval of this minor subdivision if the following <br /> requirements are met: <br /> 1. The applicant shall submit the signed, revised easements prior to the City Council's <br /> action on this item. The easements are expected for your meeting on December 4. <br /> 2. The applicant shall provide the City with a park dedication fee in the amount of <br /> $100 per Code requirements in Section 1204.02. <br /> 3. The applicant shall provide the City with notarized letters of permission from • <br /> William Culpert and Richard Edin, owners of 7532 and 7540 Silver Lake Road, <br /> respectively. <br />
