MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 11-81 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION RECOMMENDING APPROVAL FOR MR. DONUT FOR A <br />CONDITIONAL USE PERMIT, MINOR SUBDIVISION AND DEVELOPMENT <br />AGREEMENT EXECUTION <br />WHEREAS, Scott Builders, Inc. has requested approval to construct <br />a convenience food establishment, Mr. Donut; and <br />WHEREAS, approval to construct the convenience food establishment, <br />Mr. Donut, requires the City to approve a conditional use permit, a <br />minor subdivision and a development agreement; and <br />WHEREAS, the Planning Commission of Mounds View has reviewed the <br />request by Scott Builders, Inc. and provisions of the Mounds View Muni- <br />cipal Code pertaining to conditional use permits, minor subdivisions and <br />development agreements; and <br />WHEREAS, the Planning Commission has received and reviewed reports <br />from the City staff and consultants regarding the request and its appli- <br />cation to Mounds View Municipal Code; <br />�. NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning <br />Commission recommends approval of Scott Builders, Inc. request to the <br />Mounds View City Council with the following considerations: <br />1. A conditional use permit be granted to include the following <br />provisions: <br />a) Joint parking covenants be required between Brooks <br />Superette and Mr. Donut to be filed and be of record <br />at Ramsey County Court House. <br />b) All conditions pertaining to the specific site are <br />subject to review and change when the City, upon <br />investigation in relation to a formal request, finds <br />1) general welfare and public betterment can be <br />served as well or better by modifying the conditions; <br />and 2) upon a change in ownership. <br />2. Minor subdivision be granted to include the following provisions: <br />a) Drainage easements be recorded for the ponding require- <br />ments of Resolution No. 983. <br />b) Utility easement for Brooks Superette be granted at <br />the time they are located or relocated. <br />
