MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 34-81 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />PLANNING COMMISSION ACTION REGARDING PLANNING CASE 92-81, <br />A CODE APPEAL <br />WHEREAS, the applicant, Gerald H. Fields, has applied for a <br />building permit which includes the extension of a four foot deck on <br />the front of his home at 2255 Lambert Avenue; and <br />WHEREAS, the Mounds View Zoning Code, Section 40.05, Subdi- <br />vision D, lists structures that shall not be considered encroachments <br />on yard setback requirements; and <br />WHEREAS, the proposed four foot deck is not listed in Section <br />40.05, Subdivision D as an exception to setback requirements; and <br />WHEREAS, the Mounds View Planning Commission has reviewed the <br />request and considers the four foot deck an architectural feature <br />that is in conformance with other exceptions listed in Section 40.05, <br />Subdivision D; <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning <br />Commission approves the code appeal of Gerald H. Fields at 2255 <br />Lambert Avenue as requested in Planning Case 92-81; <br />BE IT FURTHER RESOLVED that the Mounds View Planning Commis- <br />sion will, in the future, recommend to the City Council that they <br />amend Section 40.05, Subdivision D, to include such architectual <br />features. <br />Adopted this 1st day of July, 1981. <br />ATTEST: <br />SEAL) <br />BUi~cial
