RESOLUTION NO. 100-83 <br />PAGE TWO <br />•WHEREAS, the existing zoning for the parcel under_ consider- <br />ation is I-1, Light Industr_ia.l; and <br />WHEREAS, a rezoning of this parcel to B-2, Limited Business <br />District has been approved as part of the Silver Lake Woods <br />development; and <br />WHEREAS, a rezoning to B-3, Highway Business District is an <br />appropriate use for this particular parcel with a convenience food <br />establishment recommended being an allowable conditional use on <br />this particular parcel; and <br />WHEREAS, the conditions for convenience food establishments <br />as outlined in Chapter 40.17, Subdivision D(1) have been met; and <br />WHEREAS, all Code requirements for minor subdivisions of <br />commercially zoned property have been met; and <br />WHEREAS, existing Code requirements for number of parking <br />spaces required for convenience food establishments greatly <br />exceeds what is actually required for this type of business; and <br />WHEREAS, the existing Code requirements for off-street <br />parking space size is 9-1/2 by 20 feet; and <br />•WHEREAS, the Planning Commission, as part of its Zoning <br />Code text review, is recommending revisions to the Zoning Code as <br />it relates to off-street parking requirements, specifically spaces <br />required for convenience food establishments and size of parking <br />spaces; and <br />WHEREAS, the Planning Commission finds the Code appeals for <br />number_ of spaces and the size of the parking space justified as a <br />result of revisions to the Code; and <br />WHEREAS, all other Zoning Code requirements, including <br />setbacks, curb cut dimensions, building heights, etc. have been <br />met; and <br />WHEREAS, City storm water runoff .requirements have been <br />reviewed by the City Engineer and meet current requirements; <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br />Planning Commission recommends approval of the request by the <br />Burger King Corporation of the following: <br />1. A rezoning of the Burger King parcel from I-1, <br />Industrial to B-3, Highway Business. <br />2. A minor subdivision of one lot into two which includes <br />utility easements as shown on the submitted site plan. <br />• 3. A conditional use permit to allow the construction of a <br />convenience .food establishment noting that all condi- <br />tions listed in Chapter 40.17, Subdivision D(1) have <br />been met. <br />
