MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 85-83 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING A DRIVEWAY SETBACK VARIANCE <br />FOR ERIC EMERSON AT 7865 SPRING LAKE ROAD <br />WHEREAS, Eric Emerson, the owner of property located at <br />7865 Spring Lake Road, is requesting to repair and resurface <br />an existing driveway which is located approximately six inches <br />from the property line; and <br />WHEREAS, the construction of any driveway to be located <br />less than five feet from a property line requires the approval of <br />a variance; and <br />WHEREAS, a legal opinion was received by the City Attorney <br />which states this application would have to be authorized by a <br />variance, a copy of the opinion is attached to this resolution; <br />and <br />WHEREAS, the surfaced driveway is preexisting and an <br />• entirely new driveway is not being proposed; and <br />WHEREAS, existing mature trees and shrubbery would have <br />to be eliminated should the driveway be placed five feet from the <br />property line. <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning <br />Commission approves a variance to Eric Emerson, located at 7865 <br />Spring Lake Road, to repair and resurface an existing driveway to <br />within six inches of the north property line from the street to the <br />garage. <br />Adopted this 15th day of June, 1983. <br />ATTEST: <br />zz" <br />Chairper. n <br />(SEAL) <br />Direr of PubW Works/ <br />Co ity Devel ment <br />is <br />
